Written in plain English rather than lawyer, because a document you did not finish reading protects nobody. If something here is unclear, do not use this until it is not.

1. What this is

Nicholas is a personal, non-commercial automated trading tool. It connects to a brokerage account you already own at Alpaca Securities LLC, using access you grant through Alpaca's own authorization screen, and places orders according to rules configured in the software.

2. It is not advice

Nothing produced by this software is investment advice, a recommendation, or a solicitation to buy or sell anything. The operator is not a registered investment adviser, broker, or dealer, and does not manage money on your behalf for compensation. You make your own decisions, including the decision to run this at all.

3. You keep the account, and the risk

• Your funds stay in your own Alpaca account at all times. Nothing is pooled, transferred, or held by the operator.
• The access granted permits placing and cancelling orders. It does not permit deposits, withdrawals, or transfers.
• Trading involves risk of loss, including total loss. Automated trading adds its own failure modes: software defects, network outages, stale data, exchange downtime and unexpected market conditions can all cause losses that a human would have avoided.
• Past performance, backtests and simulations do not predict future results. A backtest is a hypothesis, not a promise.

4. No warranty

This software is provided "as is", without warranty of any kind, express or implied. The operator does not warrant that it will run continuously, without error, or profitably. To the maximum extent permitted by law, the operator is not liable for any trading losses, lost profits, or damages arising from its use.

5. Your responsibilities

• Use it only with an account you own and are permitted to trade.
• Keep your dashboard link private. It is a credential.
• Monitor it. "Set and forget" means check in, not never look again.
• Comply with the law where you live, and with Alpaca's own terms.

6. Ending it

You may revoke access at any time from your Alpaca dashboard, with no notice and no involvement from the operator — it takes effect immediately and the software simply stops being able to act. The operator may also stop running it for you at any time, for any reason, including not wanting to any more.

7. Changes

These terms may change as the software does. Continuing to use it after a change means you accept the current version.
